⚖️ Musk's Lawsuit Against OpenAI Heats Up!

Remember Elon Musk’s lawsuit against OpenAI, which accused the company of abandoning its non-profit mission and was withdrawn in July but made a dramatic comeback in August?

The suit has added new defendants and plaintiffs.

Now, alongside OpenAI, the amended complaint names Microsoft, LinkedIn co-founder Reid Hoffman, former OpenAI board member Dee Templeton, and California Attorney General Rob Bonta as defendants.

Meanwhile, Musk’s AI company, xAI, and Shivon Zilis, a Neuralink executive and ex-OpenAI board member, have also been named plaintiffs.

Let’s dive into the rationale behind these new additions, shall we:

Musk’s legal team argues that OpenAI has crossed a line by allegedly attempting to squash competition, such as from xAI, by “extracting promises from investors not to fund them.”

They claim that OpenAI also unfairly benefits Microsoft’s vast resources and expertise, likening their relationship to a “de facto merger.”

Hoffman’s dual roles on the boards of Microsoft and OpenAI and as a partner at Greylock, the investment firm, deepen the complexities.

This gives Hoffman a privileged—and illicit—view into the companies’ dealings, the complaint alleges.

But not that Hoffman stepped down from OpenAI’s board in 2023.

Musk's legal team also points out that Greylock invested in Inflection, the AI startup that Microsoft acquired earlier this year—and which, according to the complaint, could reasonably be considered an OpenAI competitor.

Then there’s Templeton, who was briefly appointed as a non-voting board observer at OpenAI by Microsoft.

The amended filing alleges that position may have allowed her to broker agreements between OpenAI and Microsoft that contravene antitrust laws.

The reports that OpenAI is in talks with California Attorney General Rob Bonta about a shift in its corporate structure adds another layer of intrigue.

And to top it off, the Complaint states that Zilis, who stepped back from OpenAI’s board in 2023 after four years, has standing as an “injured employee” under the California Corporations Code.

That’s a whole lot, right? But there are even more details in the amended complaint here.

In all this chaos, OpenAI is pushing back, seeking to dismiss Musk’s lawsuit, which it calls “blusterous” and baseless.

📸 TikTok Integrates Getty Images for AI-Powered Ads!

Thanks to a new integration with Getty Images, advertisers can now access a treasure trove of licensed images and videos to make ads containing AI-generated content.
